Arkansas zoning and business permits
Zoning approval and a business license answer different questions. Use this guide to verify the location, planned activity, property changes, and local permissions before opening.

Start with zoning. Zoning determines whether the planned activity is allowed at the address and under what conditions. A business or privilege license generally authorizes the business to operate in that jurisdiction. Receiving one does not necessarily replace the other.
ASBTDC: zoning and local requirements1. Identify the correct jurisdiction
Confirm whether the address is inside city limits. Inside a city, begin with its planning, zoning, development, or clerk's office. Outside city limits, start with the county and ask which office controls land use and local business requirements. A mailing address alone may not settle the jurisdiction.
2. Describe the complete business use
Give the local office more than a business name. Explain the services or products, customer traffic, number of workers, hours, deliveries, vehicles, equipment, outdoor activity, storage, noise, and hazardous materials. These details can affect whether the use is allowed or needs review.
3. Ask about property and sign permits
Moving into an existing space does not always mean it is approved for the new use. Ask whether a change of use, occupancy review, building permit, electrical or plumbing permit, fire inspection, health approval, parking review, or sign permit applies before construction or installation begins.

Home-based and online businesses can still be subject to local land-use rules. Ask about a home-occupation permit and limits on visitors, employees, commercial vehicles, parking, signs, inventory, accessory buildings, deliveries, or visible changes to the property. Also review lease, landlord, or neighborhood restrictions separately.
5. Separate zoning from industry approval
A permitted location does not prove that the activity has every professional, health, contractor, alcohol, childcare, or other industry approval it needs. Run the local zoning check and the state or industry-license check as separate tasks.

Keep the application, approval, conditions, site plan, inspection record, receipt, permit number, and renewal date. If an office says no permit is required, ask whether written confirmation is available. Save the name of the office and the date of every verification.
Questions for the planning or zoning office
- Is this exact use allowed at this exact address?
- Does the use need administrative approval, a hearing, or a special permit?
- Is a home-occupation, occupancy, building, fire, health, or sign approval required?
- Are parking, traffic, hours, employees, storage, deliveries, or noise restricted?
- What must be approved before a local business-license application?
